Platform Liability Limitation

The maximum extent of NettulzTech Corp's liability to platform users.

⚠ Important: READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY LIMITS NETTULZTECH CORP'S LIABILITY TO YOU.

1. Maximum Liability Cap

Liability is capped at 12-month subscription fees paid.

To the maximum extent permitted by applicable law, NettulzTech Corp's total aggregate liability to any user for any claim arising from or related to the platform shall not exceed the total fees paid by that user during the twelve (12) months immediately preceding the event giving rise to the claim.

2. Excluded Liability Categories

NettulzTech Corp expressly excludes all liability for the following, regardless of whether the Company was advised of the possibility of such damages:

  • •Lost profits, revenue, or income from mining operations.
  • •Commodity trading losses or investment losses.
  • •Production interruptions or mine downtime.
  • •Equipment failure or damage informed by AI recommendations.
  • •Environmental remediation costs.
  • •Regulatory fines, penalties, or license revocations.
  • •Third-party claims against the user arising from platform use.
  • •Indirect, incidental, consequential, special, or punitive damages.
  • •Data loss, corruption, or breach caused by third-party infrastructure.
  • •Losses arising from satellite data inaccuracies.
  • •Losses from API provider outages or service interruptions.

3. Force Majeure & Infrastructure Disruptions

NettulzTech Corp is not liable for service interruptions or data disruptions caused by:

  • •Satellite provider outages or data gaps.
  • •Cloud infrastructure provider failures.
  • •Cybersecurity attacks, DDoS attacks, or data breaches caused by sophisticated threat actors.
  • •Natural disasters, pandemics, or force majeure events.
  • •Geopolitical conflicts affecting internet infrastructure or data providers.
  • •Internet service provider outages.
  • •Government-ordered shutdowns or regulatory actions.

4. Data Liability Disclaimer

  • •The platform is not liable for losses resulting from incorrect user-uploaded datasets.
  • •Outdated geological information provided by third-party sources.
  • •Government database inaccuracies incorporated into AI analyses.
  • •API provider data errors affecting platform outputs.

B2B Proprietary Geodata Confidentiality Provision

All client-uploaded drilling logs, geological datasets, exploration vectors, and proprietary geodata submitted to the NettulzAI platform are strictly sandboxed within the client's isolated namespace. Confidential client geodata is expressly excluded from any public model retraining pipelines, cross-tenant aggregation, or shared intelligence datasets. No identifiable client geodata is used to retrain, fine-tune, or improve global AI models without the explicit written consent of the data owner. Anonymized, aggregated, non-identifiable statistics may be derived only where permitted under the client's subscription tier and Data Processing Agreement. This provision survives termination of the subscription agreement.
